Agreement Overview
These Terms & Conditions govern your use of this website and any enquiries, quotations, bookings or services provided by DJ Shaun. By accessing the website, submitting a form or booking services, you agree to be bound by these terms to the extent permitted by law.
Booking Confirmation
Securing Your Date
A booking is only confirmed once a deposit or agreed confirmation payment has been received and DJ Shaun has issued written confirmation. No date will be regarded as reserved until confirmation has been provided.
Payments & Deposits
Financial Terms
A non-refundable deposit may be required to secure an event date. The balance of the fee must be paid in accordance with the agreed payment terms, whether before the event date, on the event date or by another agreed arrangement. Late payments may affect service delivery or confirmation.
Cancellations
Cancellation Policy
Cancellations must be made in writing. Deposits are generally non-refundable unless otherwise agreed in writing. Where cancellation occurs after planning, supplier commitments or preparation has already taken place, additional charges may apply depending on the circumstances.
Client Responsibilities
Client Obligations
The client is responsible for providing accurate event information, ensuring access to the venue, confirming timing, and making sure a suitable performance area and stable power supply are available. The client must also disclose any venue restrictions or special requirements that may affect service delivery.
Limitation of Liability
Liability Limitations
To the fullest extent permitted by law, DJ Shaun shall not be liable for indirect, special or consequential damages arising from website use, booking delays, event interruptions or circumstances outside reasonable control. Liability, where it exists, is limited to the amount paid for the relevant service unless otherwise required by law.
Intellectual Property
Ownership Rights
All content on this website, including text, branding, images, layouts, graphics and other materials, remains the property of DJ Shaun or the relevant rights holder unless otherwise stated. No content may be copied, reproduced, republished or used without prior written permission.
Governing Law
Legal Jurisdiction
These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or related services will be subject to the jurisdiction of the appropriate South African courts unless otherwise agreed.
Quotes & Pricing
Pricing Structure
Quotes are based on the information provided at the time of enquiry, including event type, location, duration, guest count and required services. If event details change, pricing may need to be revised. Quotations are valid for the period stated in the quote, if any, and may be withdrawn or updated if circumstances change.
Event Details & Changes
Event Amendments
Clients should provide full and accurate event details when making an enquiry or booking. Any material changes, including venue changes, time changes, guest count changes or additions to the required services, must be communicated as soon as possible and may affect pricing, setup requirements or availability.
Rescheduling
Date Changes
If an event is rescheduled, DJ Shaun will make reasonable efforts to accommodate the new date, subject to availability. Rescheduling does not guarantee the same pricing or supplier availability, and reasonable additional charges may apply depending on the notice period and circumstances.
Access, Setup & Power
Technical Requirements
The client must ensure that DJ Shaun has reasonable access to the venue for setup and breakdown and that the performance area is safe, dry, accessible and supported by a stable power source. DJ Shaun reserves the right to adjust or suspend service where conditions are unsafe or unsuitable.
Venue Rules & Permissions
Venue Compliance
The client is responsible for understanding and complying with venue rules, including noise limits, loading access, curfews, power availability and permissions. Where required, the client must obtain approval from the venue for DJs, lighting, smoke effects, sparks, screens or any other requested services.
Overtime & Extensions
Additional Performance Time
Any extension beyond the agreed service time is subject to DJ Shaun’s availability and discretion. Additional charges may apply for overtime, extended setup, delayed schedules or last-minute changes requested on the event day.
Equipment Care & Damage
Equipment Responsibility
Clients must take reasonable steps to ensure that guests, staff and third parties do not interfere with or damage equipment. The client may be held responsible for loss or damage caused by guests or persons under the client’s control where such loss or damage results from negligence, misconduct or unsafe conditions.
Safety & Conduct
Behaviour Standards
DJ Shaun reserves the right to suspend or terminate services where there is threatening behaviour, harassment, unsafe conduct, illegal activity or conditions that place people or equipment at risk. In such cases, fees paid remain payable and refunds are not automatically due.
Force Majeure
Unforeseen Circumstances
DJ Shaun will not be responsible for failure or delay in performance caused by events beyond reasonable control, including extreme weather, load shedding, venue closure, government restrictions, illness, accidents, civil unrest or similar circumstances. Where possible, alternative arrangements may be discussed in good faith.
Media & Recording
Use of Event Media
Event photographs or videos may be captured by the client, venue, guests or other suppliers. DJ Shaun may request permission to use selected event media for portfolio or marketing purposes. If you do not wish event media to be used in this way, this should be communicated in writing in advance.
Refunds
Refund Policy
Refunds, where applicable, will be handled in accordance with the agreed booking terms and the reason for cancellation or non-performance. Deposits are generally non-refundable. Any approved refund will be processed within a reasonable period using an appropriate payment method.
Dispute Resolution
Conflict Resolution
If a dispute arises, the parties should first attempt to resolve the matter through direct communication in good faith. If the matter cannot be resolved informally, the parties may consider mediation or proceed through the appropriate legal channels in South Africa.
